Acceptance of Terms
By using LeadNest LLC’s services, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service.

1. Compliance with Laws
By using our services, you agree that all activities, including sending SMS messages or any other communications, will fully comply with all applicable laws, rules, and regulations, including but not limited to the Telephone Consumer Protection Act (TCPA), CAN-SPAM Act, GDPR, and any other federal, state, or local regulations governing electronic communications.

2. User Responsibility
You are solely responsible for obtaining any necessary consent from recipients before sending messages, maintaining records of consent, and ensuring that your communications do not violate any laws or third-party rights.

3. Prohibited Activities
You may not use our services to:

Send unsolicited or spam messages.

Violate the rights of any person or entity.

Attempt to circumvent or bypass any applicable laws or regulations governing messaging.

4. Indemnification
You agree to indemnify, defend, and hold harmless LeadNest LLC, its affiliates, officers, and employees from any claims, damages, fines, penalties, or losses arising out of or relating to your use of the service, including but not limited to any non-compliant messaging activities.

5. Termination
We reserve the right to suspend or terminate your account immediately if we believe your activities are unlawful or in violation of these Terms of Service.

6. No Liability for Compliance
LeadNest LLC provides the software platform and tools only. You acknowledge and agree that we are not responsible for ensuring your compliance with any laws. You assume all risk and liability for your messaging activities.

7. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
